Terms of service
1. Overview
Welcome to Fjordkin (“Fjordkin,” “we,” “us,” “our”). We operate this website and storefront (the “Services”) to sell made-to-order products produced in the USA through trusted print partners. Our store is powered by Shopify. By using the Services, you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the Services.
Merchant of record: Fjordkin is operated from Sweden by Toor Innovation AB, a Swedish company.
2. Eligibility & Accounts
You represent you are the age of majority in your state of residence, and you consent to use by minors on devices you manage. You’re responsible for account security and for providing accurate information.
3. Made-to-Order Products (incl. Size-Chart Notice)
All items are made to order after purchase. Colors/placements may vary slightly from on-screen images due to device settings and print processes. We may limit or discontinue products at any time.
Size-Chart Notice: Please verify your size using the size chart on each product page before ordering. Because items are produced on demand, we do not accept returns/exchanges for buyer’s remorse, wrong size, or color. See our Refund Policy.
4. Orders, Changes & Cancellations
Placing an order is an offer to buy. We may accept or decline any order. Payment authorization is required before acceptance. Edits/cancellations are only possible before production starts. If we change or cancel an order, we’ll notify you using your provided contact details. Purchases are for personal use, not resale/export.
5. Pricing, Taxes & Billing
Prices/promotions may change without notice. Checkout price applies. Unless stated, prices exclude taxes, shipping, and handling. You agree to keep payment details current and authorize charges for your order total.
6. Shipping, Delivery, Split Shipments & Risk of Loss
We ship within the United States only. Delivery windows are estimates and not guaranteed; we are not liable for carrier/weather/events beyond our control. Title and risk of loss transfer to you when the order is handed to the carrier.
Split Shipments: Items in the same order may ship separately from different U.S. facilities. You’ll receive tracking as available.
7. Lost, Undeliverable, or Address Issues
If a carrier confirms a package is lost in transit, we will replace or refund according to our Refund Policy. If a package is returned or undeliverable due to an invalid/insufficient address or repeated delivery failures, we can reship for an additional shipping charge (shipping is non-refundable).
8. Third-Party Fulfillment & Tools
We use third-party print/fulfillment partners (e.g., via Printify) and other providers. Access to third-party tools/content is provided “as is”; use is at your own risk and subject to third-party terms.
9. Returns, Replacements & Refunds (Summary)
Because products are made to order, no returns/exchanges for buyer’s remorse, wrong size, or color. If your item arrives damaged, misprinted, or incorrect, contact info@fjordkin.com within 30 days of delivery with your order number and clear photos. We’ll provide a free replacement or refund when verified, no need to mail the item back. See full Refund Policy.
10. Intellectual Property & Feedback
All Service content is owned by Fjordkin or licensors and protected by law. Personal, non-commercial use only. If you submit reviews/photos/ideas (“Feedback”), you grant Fjordkin a perpetual, worldwide, royalty-free, sublicensable license to use and display them. You warrant you own the rights and your content is lawful and non-infringing.
11. Prohibited Uses
Don’t misuse the Services (illegality, IP infringement, malware, scraping, spam, bypassing security, etc.). We may suspend/terminate access for violations.
12. Relationship with Shopify
Fjordkin is powered by Shopify, but sales are between you and Fjordkin. Shopify is not responsible for your purchases. You expressly release Shopify from claims arising from your transactions with Fjordkin.
13. Privacy
Personal information is handled per our Privacy Policy and Shopify’s privacy practices. Because our store is hosted by Shopify, information may be processed by Shopify and service providers in and outside the U.S.
14. Errors & Availability
We may correct errors or update information (including pricing/availability) and cancel affected orders at any time.
15. Disclaimer of Warranties
Except as expressly stated by Fjordkin in writing, the Services, and products are provided “as is” and “as available.” We disclaim all implied warranties to the fullest extent permitted by law.
16. Limitation of Liability
To the fullest extent permitted by law, Fjordkin and its officers/employees/partners/providers are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits/revenue/data/use. Our total liability will not exceed the amount you paid for the product giving rise to the claim.
17. Indemnification
You agree to indemnify and hold harmless Fjordkin and its affiliates/service providers from claims arising out of your breach of these Terms, law, or third-party rights.
18. Governing Law & Venue (Sweden-Based Seller)
These Terms are governed by the laws of the Kingdom of Sweden, without regard to conflict-of-laws rules. You consent to exclusive jurisdiction and venue in the courts of Stockholm, Sweden. If mandatory U.S. consumer protection laws apply to your purchase, those rights are not waived.
19. Severability; Waiver; Assignment
If any provision is unenforceable, the remainder stays in effect. Our failure to enforce is not a waiver. You may not assign these Terms without our consent; we may assign without restriction.
20. Changes to the Terms
We may update these Terms from time to time. Material changes will be posted with an effective date. Continued use after changes are effective constitutes acceptance.
